These Terms of Service ("Terms") constitute a legally binding agreement between you (an individual or the organization you represent, collectively "you" or "Customer") and IwasuBrief ("we," "us," or "our"), governing your access to and use of:

4.1 WhatsApp Business API Compliance

IwasuAssist's WhatsApp functionality is built on the Meta WhatsApp Business API. By enabling IwasuAssist for WhatsApp, you agree to comply with:

You are responsible for the deployment and use of IwasuAssist within your organization. We are not responsible for the content of conversations between your congregation members and IwasuAssist, or for any misuse by End Users facilitated by your deployment.

5. Content and Intellectual Property

5.1 Your Content

You retain full ownership of all Content you upload to the Services. By uploading Content, you grant us a limited, non-exclusive, royalty-free license to process, store, transmit, and display your Content solely as necessary to provide the Services to you.

5.2 AI Outputs

AI Outputs generated from your Content are owned by you, subject to these Terms. We do not claim ownership of your AI Outputs. You are responsible for reviewing AI Outputs before distribution and for ensuring they accurately represent the original sermon content.

5.3 Our Intellectual Property

The IwasuBrief platform, including all software, AI models, interfaces, branding, and documentation, remains the exclusive property of IwasuBrief. Nothing in these Terms transfers ownership of our intellectual property to you.

5.4 Feedback

If you provide suggestions, feedback, or ideas about the Services, you grant us the right to use that feedback without restriction or compensation to you.

5.5 No AI Training on Your Content

We do not use your uploaded Content or AI Outputs to train, fine-tune, or improve AI models for use outside your Organization's account without your explicit written consent.

Our collection and use of your personal data and your congregation members' data is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Services, you agree to the practices described in the Privacy Policy.

As the Organization deploying IwasuAssist to End Users, you act as a data controller for your congregation members' data. You are responsible for maintaining lawful bases for processing their data and for providing them with appropriate privacy notices.

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT.

We do not warrant that AI Outputs will be error-free, complete, or suitable for any particular religious, legal, or educational purpose. You are solely responsible for reviewing and approving all AI-generated content before distribution to your congregation.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IWASUBRIEF SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS INTERRUPTION, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ANY CLAIMS ARISING UNDER THESE TERMS SHALL NOT EXCEED THE GREATER OF (A) THE FEES YOU PAID TO US IN THE THREE MONTHS PRECEDING THE CLAIM OR (B) ONE HUNDRED US DOLLARS (USD $100).

You agree to indemnify, defend, and hold harmless IwasuBrief and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or relating to:

13. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict-of-law provisions.

Any dispute arising from these Terms or your use of the Services shall first be submitted to informal negotiation by contacting us at policy@iwasubrief.org. If the dispute is not resolved within 30 days, it shall be resolved by binding arbitration administered under the rules of the American Arbitration Association (AAA), conducted in English in the State of Delaware.

You waive any right to participate in a class-action lawsuit or class-wide arbitration against IwasuBrief.

We may update these Terms from time to time. When we do, we will update the "Last updated" date at the top of this page and, for material changes, notify Organization Administrators by email at least 14 days before the changes take effect. Continued use of the Services after the effective date constitutes your acceptance of the revised Terms.
